1. Acceptance of Terms
By accessing or using the viagogo platform ("Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use our Platform. These Terms constitute a legally binding agreement between you and viagogo GmbH.
2. Platform Description
viagogo is an online ticket marketplace that facilitates the buying and selling of tickets for live events including sports, concerts, theatre, and other entertainment. viagogo acts solely as an intermediary between buyers and sellers and is not the organiser of any event nor the original ticket issuer.
3. User Accounts
- You must be at least 18 years of age to create an account on the Platform.
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate, current, and complete information during registration.
- You are responsible for all activities that occur under your account.
- viagogo reserves the right to suspend or terminate accounts that violate these Terms.
- One person may only maintain one active account at a time.
4. Buying Tickets
- All sales are final. Once a purchase is confirmed, it cannot be cancelled or refunded unless the event is cancelled.
- Ticket prices may differ from face value and include service fees, order processing fees, and applicable taxes.
- viagogo guarantees that you will receive valid tickets to the event or a full refund.
- Buyers are responsible for reviewing event details including date, time, venue, and seat information before purchase.
- viagogo may cancel orders at its discretion, including in cases of suspected fraud.
- Delivery of tickets will be completed prior to the event in accordance with the delivery method selected.
5. Selling Tickets
- Sellers must only list tickets they legally own and have the right to sell.
- By listing a ticket, you guarantee that it is valid, not reported lost or stolen, and will grant entry to the event.
- Sellers agree to fulfil all confirmed orders. Failure to do so may result in account suspension and financial penalties.
- viagogo charges a seller service fee on each completed transaction.
- Payment to sellers is processed after the event has taken place and the buyer has confirmed receipt of valid tickets.
- Sellers are solely responsible for any tax obligations arising from sales.
6. Prohibited Conduct
- Using automated tools, bots, or scripts to access, scrape, or purchase tickets.
- Listing counterfeit, invalid, or fraudulent tickets on the Platform.
- Circumventing any technical measures designed to protect the Platform.
- Engaging in any activity that disrupts or interferes with the Platform's operation.
- Violating any applicable local, national, or international law or regulation.
- Impersonating any person or entity or misrepresenting your affiliation.
7. Intellectual Property
All content on the Platform, including but not limited to text, graphics, logos, images, and software, is the property of viagogo GmbH or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.
8. Limitation of Liability
To the fullest extent permitted by applicable law, viagogo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform. Our total liability to you for any claim arising out of these Terms shall not exceed the amount paid by you in the transaction giving rise to the claim.
9. Dispute Resolution
Any disputes arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the Swiss Chambers' Arbitration Institution, with proceedings conducted in English in Zurich, Switzerland.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the courts of Zurich, Switzerland for any disputes that are not subject to arbitration.
11. Changes to Terms
viagogo reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the date at the top of this page. Your continued use of the Platform after such changes constitutes your acceptance of the updated Terms.
